1. Final Sale; Estimated Shipping & Taxes and Order Review

All sales are final by default. Exceptions require approval from Customer Service.

Taxes and shipping charges are estimates only and may be adjusted during order processing.

Important: If actual shipping costs exceed the estimated amount shown at checkout, the difference will be charged to your payment method.

Orders may be reviewed and modified due to hazardous material classifications, carrier restrictions, or delivery address limitations.

Products are for commercial/business use only.

2. Order Processing & Acceptance

• Orders are typically processed within 1–2 business days of receipt.
• Processing may take longer if items are out of stock.
• Order acceptance: your order is considered an offer to purchase. AquaPhoenix is not obligated to accept every order. Acceptance occurs only when you receive a confirmation email.

3. Order Cancellation

Orders may be cancelled before order confirmation by:

• Visiting the website
• Emailing info@aquaphoenixsci.com
• Calling Customer Service at 866-632-1291

Once an order is confirmed, cancellation is subject to Customer Service approval (final sale rules apply).

4. Existing Customers and Account Linking

• First-time eStore customers who already have an AquaPhoenix account must have their eStore account linked to their main account to receive correct pricing, tax exemptions, and terms.
• Linking typically takes 2–3 business days and can be requested via the account linking form on the Site.
• No refunds for taxes, shipping, pricing differences, or credit card surcharge fees if account linking is not completed prior to ordering.

5. Eligibility to Purchase

You may not order if:

• You do not agree to these Terms;
• You are under 18 (or the legal age to contract);
• You are prohibited by law from using the Site.

All products are for commercial/business use only.

6. Pricing and Payment

• Prices are subject to change without notice.
• Payment must be received prior to order acceptance unless special arrangements are approved by the Finance Team.
• Accepted payment methods: major credit cards and ACH (pre-approved).

Credit Card Surcharge Fee

Customers who do not have an existing AquaPhoenix account at the time of purchase and who pay by credit card through the eStore will be charged a credit card surcharge fee based on the order total at checkout. The surcharge fee will be displayed during checkout and included in the total amount charged to the payment method.

Customers with an existing AquaPhoenix account that has been properly linked to their eStore account are not subject to this surcharge fee. Customers are responsible for ensuring account linking is completed prior to placing an order.

No refunds, credits, or adjustments will be issued for credit card surcharge fees applied to orders placed prior to account linking being completed.

7. Intellectual Property

• All intellectual property remains the property of AquaPhoenix or its licensors.
• You may not:
  • Resell, copy, or modify products
  • Reverse engineer products
  • Sublicense or distribute products

8. Privacy

All personal information is handled according to our Privacy Policy.

9. Warranty, Product Use & Liability

AquaPhoenix provides warranties based on product type. Customers assume responsibility for safe and legal use of all products and agree to indemnify AquaPhoenix against misuse-related claims.

All other warranties, express or implied, are disclaimed. Liability is limited as stated.

10. Returns / RMA Policy

• All returns require an RMA.
• Must be requested within 30 days of shipment.
• Returns subject to approval and possible restocking fees.

11. Governing Law

• These Terms are governed by the laws of Pennsylvania.
• Disputes must be brought in Pennsylvania courts.

12. Website Terms of Use

• These Terms are part of the broader Website Terms of Use.
• Continued use of the Site constitutes acceptance of updates.

13. General Terms & Conditions

These Online Ordering Terms & Conditions apply specifically to purchases made through the AquaPhoenix eStore and online platforms.

For all purchases, these Online Ordering Terms & Conditions are incorporated with and supplemented by the AquaPhoenix General Terms & Conditions.

In the event of any conflict between these documents, the AquaPhoenix General Terms & Conditions shall control unless expressly stated otherwise.

By placing an order through the eStore, you acknowledge and agree to both the Online Ordering Terms & Conditions and the General Terms & Conditions.
